Data Protection and Privacy Statement

NXTDEV Advisors Ltd ("NXTDEV", "we", "our") is the data controller for personal data submitted through the NXT Activate website and accelerator application process. NXTDEV is a company registered in England and Wales. This statement explains what personal data we collect, how we use it, who we share it with, and the rights you have in relation to that data under the UK General Data Protection Regulation and the Data Protection Act 2018.

What data we collect
When you apply to the NXT Activate accelerator program or otherwise engage with the application process, we collect personal data about applicants, founders, and named team members. This typically includes name, contact details, professional background and CV information, details of the company being submitted for assessment, business plans, financial information, technical materials, pitch documents, and any further information you choose to provide. We also collect basic technical data when you use the website (IP address, browser type, pages visited) for security and site operation purposes.

Why we collect it and the legal basis for processing
We process this data for the purpose of assessing applications to the NXT Activate accelerator program, communicating with applicants about the application and selection process, supporting selected cohort companies during the program, and complying with our legal and regulatory obligations. Our legal basis for processing application data is the performance of pre-contractual steps at your request, namely your application to participate in the program. For ongoing communications with selected cohort companies, our legal basis is the performance of the participation agreement entered into between NXTDEV and each cohort company. Where we rely on legitimate interests (for example, in maintaining records of past applications for program governance purposes), we have assessed those interests against your rights and concluded that processing is proportionate.

Who sees your data
Personal data submitted through the application process is shared only with the NXT Activate Selection Committee, which consists of representatives of the consortium Members ("Members") who jointly assess applications for cohort participation. The current Members are listed on the NXT Activate website. Members access application data solely for the purpose of evaluating applications and selecting cohort participants. Application data is not shared with any other third parties except where required by law, and is not used for marketing purposes by NXTDEV, by Members, or by any other party.

Where the program is supported by service providers (for example, website hosting, application management software, email communication tools), those providers may process personal data on our behalf as processors under written contracts that require them to handle the data in accordance with this statement and applicable law. We use reputable providers and require appropriate technical and organisational safeguards.

Marketing
We do not use application data, cohort participant data, or any data collected through the NXT Activate website for marketing purposes. We do not add applicants or cohort participants to marketing lists. We do not share data with our affiliated publications (AEC Magazine, Develop3D) or with the NXT BLD and NXT DEV event teams for marketing purposes. Editorial coverage of cohort companies by AEC Magazine, if any, follows the editorial team's independent judgement and is not driven by access to application data.

How long we keep it
We retain application data for the duration of the application assessment process and for a reasonable period thereafter for program governance and audit purposes. Unsuccessful applications are typically retained for up to 24 months from the close of the relevant application window, after which they are deleted or anonymised unless we have a legal or regulatory reason to retain them longer. Data relating to selected cohort companies is retained for the duration of the participation agreement and for a period thereafter consistent with our legal, tax, and regulatory obligations.

Where your data is stored
Personal data is processed and stored within the United Kingdom and the European Economic Area. Where data is transferred outside the UK or EEA (for example, where a Member or service provider is based elsewhere), we ensure such transfers are subject to appropriate safeguards under UK GDPR, including standard contractual clauses or other recognised mechanisms.

Your rights
Under UK GDPR you have the right to request access to the personal data we hold about you, to request correction of inaccurate data, to request deletion of data in certain circumstances, to object to or restrict certain processing, and to request portability of data you have provided. You also have the right to withdraw consent where we rely on consent for any processing (although the legal basis for the application process is contractual rather than consent-based). To exercise any of these rights, please contact us using the details below. You also have the right to complain to the Information Commissioner's Office (ico.org.uk) if you believe we have not handled your personal data in accordance with applicable law.
